On 6th July 2017, FSSAI issued a new amendment regarding standardization of Food Safety and Standards (Food Product Standards and Food Additives) Amendment Regulations 2017 for Non-Carbonated Water Based Beverages, which are non-alcoholic with immediate effect.
This amendment was brought to the notice of the stakeholders in the food industry via draft issued on 10th October, 2016. This was followed by a series of requests and opinions from the same, asking for the compliance period, during which adequate liquidation of inventory would be possible. With the powers vested on FSSAI by the FSSA, 2006 (Section 92 of Food Safety and Standards Act, 2006), this amendment was drafted and is now valid from 6th July, 2017.
Following this, FSSAI now directs all the Food Commissioners of the States/UTs to implement the above-mentioned amendment by the power vested by Section 16(5) FSSA, 2006.
What is the amendment?
All Food Business Operators (if relevant) shall follow the specifications mentioned under the said amendment. The enforcement of these regulations shall commence only after the final regulations are notified in the Gazette of India.
These changes are brought in Regulation 2.10 concerning to ‘Beverages’ (Other than Dairy and Fruits & Vegetables based). Under this, in sub-regulation 2.10.6 post the clause 2 (Caffeinated Beverages), the following amendment is inserted –
As quoted in the Document, ‘Non-carbonated Water – Based Beverages (Non-Alcoholic) means beverages containing water conforming to the standards prescribed for packaged drinking water under these regulations without added carbon dioxide and may contain ingredients as per sub-clause (i), singly or in combination.’
Under this, several ingredients, additives along with their permissible limits and hygiene & Labelling regulations are stated.
(i) Ingredients – Several permissible ingredients like Sugar, liquid glucose, Dextrose monohydrate, invert sugar, salt and it’s substitutes, etc are mentioned that can be used singly or in combination. Special mention of caffeine is made here – Non-carbonated water may contain caffeine not exceeding 145 parts per million from any source it may be obtained from.
Other than that, if herbs used, they shall comply with the safety requirements specified in the FSSA 2006 and the regulations made henceforth. These changes shall also be mentioned on the label.
(ii) Food Additives – Only those additives mentioned in Appendix A within the permissible limits shall be used in the product.
(iii) Hygiene – The products shall comply with the microbiological requirements given in Appendix B of these regulations.
(iv) Labelling – The products shall comply with the packaging and labelling requirements as stated under the Food Safety and Standards (Packaging and Labelling) Regulations, 2011.
There is also added a special note, which addresses two major concerns:
1. Presentation of Toxicological studies and results of the herbs used which are other than those mentioned in Food Safety and Standards (Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for special medical Purpose, Functional Food and Novel Food) Regulations, 2016.
2. The products shall not use any psychotropic substance as defined in the Schedule to the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985) and the rules made thereafter, as well as the substances listed in Schedule E and E1 of the Drugs and Cosmetics Rules, 1945.
The key point in this amendment is the Microbiological Requirements that are inserted-
